Agreement

By using Wendy ("the Service"), you agree to these terms. "You" means the business owner or authorized representative subscribing to the Service.

Service description

Wendy is an AI-powered voice receptionist that answers inbound calls on your behalf, handles bookings, provides information, and escalates calls according to rules you define. Wendy integrates with your existing calendar, SMS, and phone systems.

Your responsibilities

• Inform your team and, where required by law, your callers that an AI system handles calls
• Ensure compliance with local recording consent laws in your jurisdiction
• Provide accurate business information for Wendy's configuration
• Maintain your calendar and integration accounts in working order

Pricing & billing

• Standard rate: $0.62 per minute
• Founding 10 rate: $0.40 per minute, locked for the life of the account in good standing
• Billing increment: 6 seconds
• Invoicing: Monthly, due within 15 days
• No setup fee for founding partners

Minutes are measured from call pickup to call end. Hold time, transfers, and voicemail recording count as active minutes.

Founding 10 commitment

Founding 10 partners receive the $0.40/min rate locked for the life of the account, subject to:

• $400/month minimum spend (equivalent to 1,000 minutes); unused credit rolls to next month
• Account must remain in good standing (invoices paid within terms)
• Rate is non-transferable upon sale of the business
• No use-it-or-lose-it — seasonal variation is expected and welcome

Uptime

We target 99.9% uptime for the Wendy service. Scheduled maintenance windows will be communicated in advance and are excluded from uptime calculations.

If Wendy doesn't pay for herself in the first 30 days, we refund your first month's bill in full. No questions asked. Email hello@getwendy.com to initiate.

Data ownership

You own your business data, call recordings, and customer information. We process it on your behalf to deliver the Service. Upon termination, we export or delete your data within 30 days at your request.

Termination

Either party may terminate with 30 days written notice. Founding 10 rate lock survives pauses up to 90 days; longer pauses may result in standard pricing upon reactivation.

Disclaimers and limitations

Wendy is an AI system and may occasionally misunderstand callers or make errors. We are not liable for missed appointments, lost business, or miscommunications arising from AI limitations. Our total liability is limited to fees paid in the prior 3 months.

Governing law

These terms are governed by the laws of the State of Texas.

Changes

We may update these terms with 30 days notice. Continued use after changes constitutes acceptance.
